　　Since animal has been provided as fellow creature of mankind by article 90a of German Civil Code and German Animal Welfare Act amended in 1998 and Austrian Federal Animal Protection Act amended in 2004，problem on legal status of animal has been regarded again by Chinese law scholars．After research，some scholars consider that animal ca become subject of legal relations In this paper，the author analyses these special legislations and special foreign cases and custom and sets forth the opinion that animal can only be object of legal relations of object of protection．
